1. Introduction

Welcome to Portal Javea ("we", "our", "us"). These Terms of Service ("Terms") govern your access to and use of the Portal Javea website and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use the Service.

Portal Javea is a luxury real estate platform operating in Javea, Alicante, Spain. We connect property buyers, sellers, and real estate agencies through our online portal.

2. Definitions

  • "User" refers to any individual or entity that accesses or uses the Service, including buyers, sellers, and visitors.
  • "Agency" refers to registered real estate agencies that list properties on the platform.
  • "Property Listing" refers to any real estate advertisement published on the Service.
  • "Account" refers to the registered profile a User creates to access certain features of the Service.
  • "Content" refers to any text, images, data, or other materials uploaded to or displayed on the Service.

3. Account Terms

To access certain features of the Service, you must create an account. When creating an account, you agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain and promptly update your account information to keep it accurate and complete.
  • Maintain the security of your password and accept all risks of unauthorized access to your account.
  • Notify us immediately if you discover or suspect any security breaches related to your account.
  • Accept responsibility for all activities that occur under your account.

You must be at least 18 years old to create an account. We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

4. Property Listings

Agencies and authorized users who publish property listings on Portal Javea agree to the following:

  • All listing information must be accurate, truthful, and not misleading.
  • Property images must accurately represent the property and must not infringe upon any third-party rights.
  • Prices must be displayed in euros and reflect the actual asking price.
  • Listings must comply with all applicable Spanish real estate advertising laws and regulations.
  • We reserve the right to remove or modify listings that violate these Terms or applicable law.

Portal Javea acts as an intermediary platform and does not guarantee the accuracy of any listing information. Users should independently verify all property details before making purchase decisions.

5. User Conduct

When using the Service, you agree not to:

  • Use the Service for any illegal or unauthorized purpose.
  • Submit false, misleading, or fraudulent information.
  • Harass, threaten, or intimidate other users.
  • Attempt to gain unauthorized access to the Service or its related systems.
  • Use automated tools to scrape, crawl, or extract data from the Service without permission.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Impersonate any person or entity, or falsely claim an affiliation with any person or entity.
  • Upload or transmit viruses, malware, or any other malicious code.

6. Payment Terms

Certain features of the Service, including premium agency subscriptions, require payment. All payments are processed securely through Stripe, our third-party payment processor.

  • All prices are displayed in euros (EUR) and include applicable VAT (IVA) unless stated otherwise.
  • Subscription fees are billed on a recurring basis according to the chosen plan (monthly or annual).
  • You authorize us to charge the payment method provided for all applicable fees.
  • Refunds are handled on a case-by-case basis and are subject to our refund policy.
  • We reserve the right to change pricing with 30 days advance notice to active subscribers.

By providing your payment information, you represent that you are authorized to use the payment method and agree to Stripe's Terms of Service.

7. Intellectual Property

The Service and its original content (excluding user-submitted content), features, and functionality are and will remain the exclusive property of Portal Javea and its licensors. The Service is protected by copyright, trademark, and other laws of Spain and the European Union.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent. Users retain ownership of content they upload but grant Portal Javea a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with the Service.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Portal Javea shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to, use of, or inability to use the Service.
  • Any conduct or content of any third party on the Service.
  • Any content obtained from the Service.
  • Unauthorized access, use, or alteration of your transmissions or content.
  • Any property transaction decisions made based on information provided through the Service.

Portal Javea does not act as a real estate broker or agent. We do not participate in negotiations or transactions between users. All property transactions are conducted directly between the parties involved.

9. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination, your right to use the Service will cease immediately. If you wish to terminate your account, you may do so by contacting us or using the account deletion feature in your profile settings.

All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Alicante, Spain.

For consumers residing in the European Union, nothing in these Terms shall affect your rights under mandatory consumer protection laws of your country of residence.
